Annex A – Cancellation and Returns Policy Special Sale of the Golan Heights Winery’s 40th Anniversary Case
1. The Site’s management operates in accordance with the provisions of the Consumer Protection Law, 5741-1981 and the regulations promulgated by virtue thereof (hereinafter: the “Law”) in all that relate to the cancellation of a remote sale transaction and the return of the Product.
2. Other than as stated in Section 3 below, the User shall be permitted to cancel or change the order in accordance with the provisions of the Law, by approaching the Winery’s Visitors Center (the details of which appear below), provided that the shipping procedure to the Order Delivery Address has not yet been started.
3. If and to the extent the order was transferred to be handled by the various courier services companies (as applicable), it will not be possible to cancel the order or to return the Product pursuant to law (other than due to a defect in accordance with the provisions of the Law)*.
4. The purchaser must examine the contents of the delivery upon receipt thereof, and compare it both to the order and to the invoice that was sent to him at the time of the purchase.**
5. In the event of a cancellation of the order by the Winery, the purchaser shall be credited the amount of the order, and in the event of a change that was approved by the Winery, the purchaser shall be credited or charged, respectively, in accordance with the order that was changed.
6. The Winery shall be permitted to renege on fulfilling a purchase contract between the purchaser and the Winery, by giving notice to the purchaser, due to a clerical error or another technical mistake.
7. If a transaction was cancelled as aforesaid, the Winery shall credit the User for any Product that was ordered and paid for and the order of which was cancelled. For the avoidance of doubt, it is clarified that no monetary credit shall be given for a Product that no monetary consideration was paid therefor.
8. If a transaction was so cancelled, the Winery shall not be responsible and shall not bear any damage, including without limitation, direct, indirect, consequential or special damage that was caused to a User or to a third party.
9. Without derogating from the provisions of the Terms and Conditions, the Winery may, at any time, as per its exclusive discretion, terminate the activity on the Site or cancel a purchase transaction that a User made, for any reason whatsoever, including without limitation, due to any one of the following cases:
9.1 The Product is out of stock.
9.2 The User’s full details, including the credit card details, were not registered, inter alia, due to failures in the computers, telephone systems or any other communication functions, in the completion of the purchasing process.
9.3 The User (whether knowingly or unknowingly) entered incorrect details (including without limitation a mistaken delivery address) and it is not possible to make telephone or email contact therewith in order to receive a correct address within 7 days from Order Date.
9.4 The User acted contrary to that stated in the Terms and Conditions or in an illegal manner or contrary to the provisions of any law.
9.5 The User is trying or tried to sabotage the Site’s activity and the making of the orders on the Site.
9.6 If the credit card in the User’s possession has been blocked or restricted for use in any manner whatsoever.
9.7 Due to war, hostilities, extensive recruitment of reserve forces, natural hazards, states of emergency, pandemic, strikes and lock-outs, or any other event that is not in the Winery’s control, including without limitation, failures in the computer or telephone systems or in any other communication systems.
* Wines cannot be returned because they can spoil as a result of not being diligently refrigerated, and naturally we will not be able to monitor this.
